Kamehameha Schools settled lawsuit for $7M cf

Kamehameha Schools paid $7
million to settle a lawsuit filed by an anonymous student who
claimed the school`s Hawaiians-first admissions policy
violates civil rights laws, according to an attorney involved
in the case. Terms of the confidential settlement have been a
closely guarded secret since it was signed in May just before
the U.S. Supreme Court was to decide whether to hear the
case.

A California partnership is moving ahead
with plans to develop a nearly 1,000-home subdivision in
south-central Maui despite opposition from the County
Department of Planning and some nearby residents. Ma’alaea
Properties LLC recently filed a draft environmental impact
statement for its estimated $400 million project called
Ma’alaea Mauka proposed for 257 acres of former sugar-cane
fields south of Wailuku.

The Special Management Area
(SMA) pernit is part of a regulatory system that helps assure
that permitted uses and activities that are defined as
developments in the SMA are carried out in compliance with
Hawaii’s Coastal Zone Management Program. The SMA application
provides a means to preserve, protect, and where possible,
restore the natural resources of the coastal zone of Hawaii
by establishing special controls on development within the
areas along the shoreline
so as to avoid the permanent loss of valuable resources and
the foreclosure of land use and management options, and insure
that adequate public access is provided to beaches,
recreational area and natural reserves.

20 years of stops and starts before forwarding the Honua‘ula

County officials said Maui must pursue
careful and sustainable planning solutions for its limited
amount of undeveloped land – most of which is currently
designated as agricultural or conservation – as the island
buttresses itself for an estimated increase from a population
of about 140,000 today to 200,000-plus permanent residents and
70,000 part-time residents by 2030.

Federal and state energy officials are
planning a major investment in new technologies in an attempt
to make Hawaii the nation’s first state to get the vast
majority of its energy from renewable sources. If Hawaii and
the Energy Department are successful in making the state
mostly energy-independent in coming decades, it could serve as
a model for the rest of the nation, which President Bush has
described as “addicted to oil.”

Jeff Hunt said Thursday that he will not support A&B
Properties’ request to the state Land Use Commission to
reclassify 94 acres in north Kihei to urban until the county
completes its long-range planning. Hunt explained the county’s
position while A&B presented its plans for a 600-unit
residential project to the Land Use Commission meeting at the

Tourists
and workers were assured Tuesday that the Maui Prince Hotel
will operate continuously through foreclosure, although there
will be some loss of jobs. The hotel was foreclosed on a week
ago, and Prince Resorts Hawaii released a statement Monday
saying it would end its management of the hotel Sept. 16
because it could not get funding assurances from the trustee
for the lender. Barry Sullivan, attorney for the trustee, said
Tuesday that two experienced hotel management companies with
strong local connections are interested in taking over

a group that purchased the resort, said: “I hope that the
Mainland lenders will allow common sense to prevail and
reconsider the action as it will certainly harm the reputation

Longshore and Warehouse Union, said the news was broken to the
resort’s more than 300 bargaining unit employees during a
meeting Monday at the hotel. “The employees are very, very
upset,” Kennison said late Monday afternoon. “They’re very

Justified?
Many (but certainly not all) expensive
wines, such as the luxury brands from LVMH—which are
advertised much like the group’s TAG Heuer watches, De Beers
diamonds, Guerlain perfume, or Louis Vuitton handbags—are
overpriced because such a large portion of their cost base is
spent on marketing. This doesn’t just go for superpremium
wines like LVMH’s Château d’Yquem, Krug, and Dom Pérignon; it
also goes for brands like Cloudy Bay, a straightforward New
Zealand Sauvignon Blanc whose price—without any apparent
change in the production method—rose from about $15 per bottle
to about $30 per bottle after LVMH acquired the brand in 2003
and began marketing Cloudy Bay as a luxury product. To me,
when the consumer dollar is going more toward advertising than
toward materials or production, it’s a paradigm case of
overpricing. It bothers me that the mainstream wine media
doesn’t take brands to task for this.

In 23 states, before a lender
can foreclose on a homeowner for defaulting on a mortgage, it
must take the homeowner to court. As we’ve seen, even with
judicial review that process has still been shot through with
problems. But for a troubled homeowner in California, Texas
and 25 other “nonjudicial” states, the robo-signing scandal
and foreclosure mess are even more dangerous because the
lender doesn’t have to go to court to foreclose. Fraudulent
paperwork can be used with impunity unless the homeowner is in
bankruptcy, which is a judicial process, or unless the
homeowner is represented in the foreclosure by an attorney who

Grand Wailea Hotel investors give up
ownership
Morgan Stanley purchased Makena Resort
for $565 million & $6.6 billion including Grand Wailea. At
that time (2007), Michael Franco, managing director of Morgan
Stanley Real Estate, told Bloomberg: “This acquisition is a
unique opportunity to acquire eight top-quality resort
properties diversified across key U.S. travel destinations. We
believe that these types of luxury hotels are extremely hard
to replicate.” Morgan Stanley Real Estate acquired part of CNL
Hotels & Resorts Inc. Morgan Stanley, the biggest real
estate buyer of the day among Wall Street investment banks, in
2007 paid $6.6 billion (including debt assumed) for eight
premier properties, including the Grand Wailea.

Target, Wal-Mart and Home Depot among national brand name tenants of
malls planned on either side of the future Ka Ono Ulu Street
