Wailea Dog Park
A park just for dogs has been built in Wailea. “There are a lot of dogs on island and a lot of people who love dogs,” explained Bud Pikrone, the Wailea Community Association general manager who spearheaded development of the Kilohana Dog Park. Located on Kilohana Street near the Wailea Fire Station, the Kilohana Park Playfield was restored and expanded with the Wailea Community Association putting in approximately $75,000 for the work that added the dog park. “Hopefully it gives people a safe place to play with their dogs,” Pikrone said. The Wailea Community Association announced that a blessing will be held for both the playfield and the new dog park.

A cat helped spare a family from death by carbon monoxide poisoning by jumping on the bed and meowing wildly as fumes filled the home, the owners said.
Freedom elusive for Maui’s dogs
The only park specifically available for dogs to run around unleashed is at the Kilohana Dog Park off Kilohana Drive in Wailea. The Maui Humane Society is working with the county Department of Parks and Recreation to develop other areas where dogs are free to roam freely, said Jocelyn Bouchard, the society’s chief executive officer. “Dogs are social creatures by nature,” she said. “It’s great for dogs to interact with each other and be dogs and do dog things.”

Friday is the ninth annual Take Your Dog to Work Day, as declared by the trade group Pet Sitters International. The employee loyalty factor is no small matter. A poll of dog owners by dogster.com and SimplyHired.com – which recently introduced a Web site to search for jobs at dog-friendly companies – finds that 49 percent of respondents would switch jobs to be able to bring their dog to work, and 55 percent would be willing to commute a longer distance.

Bark park group is working with help of Maui Humane Society to help create a prerequisite for dog owners who want to use the parks, a “Pooch Pass.” The passes would probably cost only a couple of dollars and help pay for some of the parks’ maintenance. (9/10)

Countrywide short sale foreclosure 3/30/07
I have a listing that is in the beginning stages of foreclosure with Countrywide.. We listed it for $200,000 Dropped the price to $195,000 on the 3rd month. Dropped the price to $190,000 on the 4th month. Got an offer for $165,000 that we countered back and forth to $171,000, that we accepted contingent on a short sale from Countrywide. We immediately dropped the price to $185,000 where as we received a backup offer for $180,000 that we also submitted to Countrywide. Three weeks later the original offer walked away because I could not get any answer from the negotiator that was assigned to the case. Now 5 weeks later our backup offer is getting antsy. The appraiser that Countrywide finally sent out, appraised it at $188,000.

Foreign Agricultural Land Owners Required to Report Investments
Foreigners who have purchased or sold ag land in the county are required to report the transaction to the FSA – Farm Service Agency within 90 days of the closing, to avoid civil penalties of up to 25% of the FMV of the property. Copies of the form can be downloaded from USDA website for FSA (Farm Service Agency) at www.fsa.usda.gov. Click on Forms, and download form FSA153
AFIDA – Agricultural Foreign Investment Disclosure Act
AFIDA – Agricultural Foreign Investment Disclosure Act. Foreign clients who acquire, transfer, or hold U.S. Ag land must report these holdings and transactions to the USDA within 90 days of such transaction. Failure to report (or late reporting) may result in penalties of up to 25% of fair market value of the land. “This rental agreement was a contract of adhesion, the judge noted, because the tenant had no bargaining power and that is contrary to public policy. The binding arbitration clause in Dino and Kim’s rental agreement was unconscionable and lacked mutuality since it was a contract of adhesion, the judge ruled. Pukalani zoning lawsuit settled
The county has lost a lawsuit over a 1964 zoning decision in the Five Trees-Corn Mill Camp area of Pukalani. Another unresolved lawsuit against the county is still in process. 2nd Circuit Judge ruled that, even after giving the break on all inferences to the county, former Planning Director Mike Foley and Public Works Director Milton Arakawa are not authorized to invalidate decades-old zoning. Hanohano is a proposed 49-unit residential project on 28 acres makai of the Five Trees intersection. It is a venture of developer Everett Dowling. 5/6/08

2nd Circuit Judge denied a Maui Lani developer’s request to dismiss a building height limit lawsuit brought by Kahului homeowners whose houses now adjoin 30 feet of fill dirt. 11/30/07
MRFPA — Mortgage Rescue Fraud Prevention Act
Mortgage Rescue Fraud Prevention Act (“MRFPA”), or Act 137, is a new law that went into effect on June 3, 2008. The stated purpose of the bill is to protect Hawai’i consumers from “persons who prey on homeowners who face property foreclosures, liens, or encumbrances.” (reprinted courtesy H.A.R. 8/14/08)
Act 137 — DPC Distressed Property Consultant
A “distressed property consultant” is a person who, among other things, solicits, represents, or offers to (1) stop or postpone the foreclosure sale, (2) stop or postpone the charging of any liens or encumbrances against any distressed property, (3) obtain any forbearance from any mortgagee or relief with respect to any tax lien sale, (4) assist in curing a default under Hawai‘i law, (5) obtain any extensions of period within which to reinstate the consumer’s rights with respect to the distressed property, (6) obtain any waiver of any acceleration clause contained in a promissory note, (7) assist the distressed property owner in foreclosure or loan default, (8) avoid or ameliorate the impairment of an owner’s credit, or (9) save the owner’s property from foreclosure or loss of home due to nonpayment of taxes. In the Palama Drive legal dispute over construction fill, 2nd Circuit Judge ruled Thursday that residents have standing to ask the courts to tell the county to abide by its own ordinances. 7/11/08
